Terms and Conditions

This agreement is between the client booking the photography session (“the Client”) and Tamara Kublashvili Photography Limited (“the Photographer”).

By confirming the booking, accepting these Terms and Conditions and paying the session fee, the Client agrees to be bound by this agreement. The booking is confirmed once the session fee has been received and confirmation has been issued by the Photographer.

The Client and the Photographer agree to cooperate and communicate with each other to achieve the best possible outcome from the photography session.

APPLICABLE LAW

The laws of England and Wales govern this agreement. These Terms and Conditions may only be varied by agreement in writing between the Client and the Photographer.

In the event of any conflict between these Terms and Conditions and any terms submitted by the Client, these Terms and Conditions will prevail unless otherwise agreed in writing.

Nothing in these Terms and Conditions affects the Client’s statutory consumer rights. If any part of this agreement is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

PAYMENT

A session fee must be paid at the time of booking to secure the photography session. Payment may be made through the website booking form or by an invoice issued directly by the Photographer.

The applicable session fee and the services included are displayed on the Price page or confirmed to the Client in writing before booking. Images, prints, albums and other photographic products are purchased separately unless expressly included in the selected package.

For newborn sessions, because the exact arrival date of the baby cannot be predicted, the expected due date will initially be reserved. The final photography date will be arranged after the baby is born and will be subject to the Photographer’s availability.

CANCELLATION

Where a statutory cancellation right applies to a booking made online or remotely, the Client may cancel by sending a clear written statement to the Photographer within 14 days of the contract being formed. If the Client asks the Photographer to begin consultation, preparation or photography services during that period, the Photographer may deduct a reasonable proportion for services already provided, where permitted by law. Nothing in these Terms and Conditions limits the Client’s statutory rights.

After any applicable statutory cancellation period has expired, the Photographer may retain all or part of the session fee if the Client cancels, but only to the extent that it reasonably reflects the work already undertaken and the losses caused by the cancellation, including reserving the session date. Any remaining balance will be refunded.

The Client may request to transfer the session to another available date by providing at least 48 hours’ notice. One transfer may be offered without an additional session fee, provided the replacement session takes place within two months of the original date and remains subject to availability.

Requests made with less than 48 hours’ notice, repeated requests to reschedule or failure to attend may be treated as a cancellation. A new session fee may be required before another date is reserved.

If the Photographer must cancel and a suitable replacement date cannot be agreed, the Client will receive a refund of any payment made for services or products that have not been provided.

SICKNESS

Children can become unwell unexpectedly. If the Client, baby, child or another participating person becomes unwell before the session, the Client should inform the Photographer as soon as reasonably possible.

Where reasonable notice is provided, the Photographer will work with the Client to arrange one replacement date within two months, subject to availability. In a genuine emergency, notice should be provided as soon as reasonably possible.

If a child becomes unwell during the photography session, the Photographer may postpone the remaining session and arrange another date where appropriate.

The Photographer may also postpone a session if continuing would create a health or safety risk for the Client, the Photographer or another person present.

EDITING

The Photographer has the exclusive right to select and edit the photographs that best reflect her professional style and quality of work.

Photographs that are duplicates, technically unsuitable or not selected for the final gallery will be discarded and will not be made available to the Client.

During the viewing and ordering appointment, the Client may request reasonable additional editing of small personal details, such as temporary blemishes. More extensive retouching or alterations may incur an additional charge, which will be confirmed before the work is undertaken.

The RAW and unedited images remain the property of the Photographer and cannot be transferred to the Client or purchased.

The Client acknowledges that differences in lighting, location, weather, cooperation and other circumstances mean that an identical recreation of a particular photograph cannot be guaranteed.

DELIVERY

Editing may take up to three weeks following the photography session. The Photographer will then arrange a date with the Client for the viewing and ordering appointment.

Estimated production and delivery times for additional products will be confirmed during the viewing and ordering appointment. Delivery times may vary depending on the product and supplier.

PRINTS

All orders for prints, albums, folio boxes, wall art and other photographic products must be paid for in full at the time of ordering. Payment may be made by bank transfer, through a payment link or using Klarna’s three-instalment payment option, with no additional charge to the Client.

The Client is responsible for checking image selections, names, wording, layouts and other personalised details before approving an order. Once a personalised product has entered production, it cannot normally be changed or cancelled.

Nothing in this section affects the Client’s statutory rights if a product is faulty, damaged or not as described.

DIGITAL PRODUCTS

Purchased digital images may be supplied by USB, secure download or another agreed digital method.

The Client is encouraged to make a backup of all digital images supplied by the Photographer on an external drive or another reliable storage system.

Once digital images have been successfully delivered, the Photographer cannot be responsible for their subsequent loss, accidental deletion or damage to the Client’s own device or storage media. The Photographer cannot guarantee that archived copies will remain available indefinitely.

COPYRIGHT

Once full payment has been received, the Client is granted a personal-use licence for the final images they have purchased.

The Client may print purchased images and share them with friends and family, including through personal social-media accounts. The images must not be sold, used commercially, supplied to another business for promotional purposes or published commercially without the Photographer’s prior written permission.

The Client may not provide the images to another professional for alteration or editing without the Photographer’s prior written permission. Watermarks or copyright notices must not be removed from watermarked images.

Screenshots or copies of images that have not been purchased are not permitted.

MISCELLANEOUS

The Photographer will exercise reasonable care, skill and diligence when providing the photography services.

In the unlikely event of equipment failure, accidental loss or corruption of the photographic files, the Photographer will make reasonable efforts to arrange another photography session. If a replacement session is not reasonably possible, the Photographer’s responsibility, to the extent permitted by law, will be limited to refunding the amounts paid for the affected services.

Nothing in these Terms and Conditions affects the Client’s statutory rights.
